MASTER SERVICE AGREEMENT & LIABILITY WAIVER

By signing an estimate, signing an invoice, making a deposit, makingpayment, approving work by email, text message, verbally authorizing work, orallowing work to begin, Customer acknowledges receipt of these Terms andConditions and agrees to be legally bound by them.

These Terms and Conditions are incorporated into all estimates, invoices,service agreements, maintenance plans, warranty programs, and work ordersissued by Crystal Clear Water Purification, Inc. ("Contractor").

If any provision of these Terms and Conditions is determined to beunenforceable, the remaining provisions shall remain in full force and effect.

1. PAYMENT TERMS & DEPOSITS

Residential & Commercial Projects: All equipment installations require adeposit equal to 50% of the contract price upon signing or accepting theestimate.

Deposit Use: Customer acknowledges that Contractor may immediately use thedeposit to purchase equipment, reserve inventory, schedule labor, obtainpermits, fabricate custom components, and allocate installation resources.

Non-Refundable Deposits: Once equipment has been ordered, fabricated,customized, scheduled, delivered, or otherwise committed to the project, all ora portion of the deposit may become non-refundable.

Final Balance: The remaining balance is due immediately upon substantialcompletion of the installation and prior to system commissioning, activation,turnover, or final hookup unless otherwise agreed in writing.

Late Payments & Default: Contractor reserves the right to delayinstallation, withhold startup, suspend warranty coverage, or withholdequipment commissioning until all balances are paid in full. Balances not paidwhen due shall accrue interest at 1.5% per month (18% annually) or the maximumamount permitted by law.

If your balance is placed with an outside collection agency, the customeragrees to pay all reasonable collection costs, collection agency fees, attorneyfees, court costs, lien preparation fees, and expenses incurred in collectingunpaid amounts.

2.     GENERAL SCOPE & SYSTEM LIMITATIONS

2.1 Scope of Work

Contractor is responsible only for the work specifically described on theaccepted estimate or invoice. Contractor is not responsible for thepre-existing condition of plumbing systems, electrical systems, irrigationsystems, structural framing, foundations, appliances, fixtures, or equipmentnot directly installed or serviced by Contractor.

2.2 Well System & Aquifer Disclaimer

Contractor does not control, own, or engineer the well, aquifer conditions,well drilling depth, well casing integrity, well yield, groundwater quality, orunderground well plumbing. Contractor shall not be responsible for failure of:

  • Well pumps
  • Pressure switches
  • Control boxes
  • Pressure tanks
  • Well casings
  • Underground well piping
  • Aquifer conditions
  • Water table fluctuations
  • Groundwater chemistry changes
  • Sand intrusion from     collapsing or deteriorating wells

2.3 Environmental & Water Quality Fluctuations

Water treatment systems improve water quality but cannot guarantee completeor permanent removal of all contaminants. Water conditions may change due to:

  • Seasonal aquifer changes
  • Environmental contamination
  • Groundwater fluctuations
  • Municipal water supply     changes
  • Plumbing conditions within     the home
  • Excessive water usage
  • Changes in well production

Contractor does not guarantee specific taste, odor, clarity, color, hardnesslevels, iron levels, sulfur levels, tannins, bacteria levels, stainingprevention, or other water characteristics unless specifically stated inwriting.

2.4 Unforeseen Conditions & Change Orders

Customer acknowledges that concealed plumbing, electrical, structural,permitting, code compliance, groundwater, well, site, drainage, excavation, orinstallation conditions may be discovered after work begins. Such conditionsmay require additional labor, materials, equipment, modifications, repairs,permits, inspections, or code upgrades not included within the originalestimate. Contractor will notify Customer of additional charges beforeproceeding whenever reasonably possible.

Additional work approved verbally, electronically, by email, text message,signature, or customer direction shall constitute an approved change order andshall be billed accordingly.

2.5 Force Majeure: Contractor shall not be responsible for delays, failures,damages, scheduling interruptions, equipment shortages, or performance issuescaused by hurricanes, tropical storms, floods, lightning, utilityinterruptions, labor disruptions, supply chain shortages, governmental actions,acts of God, or circumstances beyond Contractor's reasonable control.

3.     PROPERTY & PLUMBING LIABILITY WAIVERS

3.1 Loosened Scale & Debris Release: Many plumbing systems containmineral deposits, pipe scale, iron buildup, sulfur deposits, sediment, andbacterial biofilm. Changes in water chemistry or standard sanitation proceduresmay loosen such debris. Contractor shall not be responsible for plumbing leaks,valve failures, fixture blockages, cartridge damage, appliance issues, orplumbing failures resulting from debris or scale becoming dislodged.

3.2 Existing Valves & Fixtures: Contractor is not responsible for thefailure, leaking, or breakage of pre-existing plumbing components including:

  • Angle stops
  • Main shut-off valves
  • Hose bibs
  • Water heater drain valves
  • Mixing valves
  • Shower cartridges
  • Washing machine valves
  • Faucets
  • Existing plumbing fittings

Repair or replacement of failed pre-existing plumbing components shall bethe responsibility of the homeowner.

3.3 Water Heaters: Changes in water chemistry, sediment disturbances,sanitations, or plumbing modifications may cause water heater components tofail. Contractor shall not be responsible for:

  • Blown heating elements
  • Failed thermostats
  • Sediment disturbances
  • Water heater leaks
  • Reduced heater performance

3.4 Existing Plumbing Risk Acknowledgement & Limitation of Liability: Customer acknowledges that existing plumbing systems, valves, fixtures, waterheaters, appliances, wells, pumps, pressure tanks, underground piping, andrelated components may contain age-related deterioration, corrosion, mineralbuildup, scale, bacterial buildup, hidden defects, or other pre-existingconditions. Changes in water chemistry, water pressure, sanitizing procedures,installation activities, excavation activities, or normal system operation mayexpose or aggravate such pre-existing conditions. Contractor shall not beresponsible for failures resulting from pre-existing conditions not caused byContractor's negligence.

Flooding & Consequential Damage Exclusion: Contractor shall not beliable for flooding, water damage, mold, mildew, structural damage, appliancedamage, lost profits, loss of use, consequential damages, or property damageresulting from plumbing failures, pressure fluctuations, clogged drains, poweroutages, customer neglect, water source changes, or pre-existing plumbingdefects.

To the fullest extent permitted by Florida law, Contractor's total liabilityarising from services provided shall not exceed the amount paid by Customer forthe specific services giving rise to the claim.

4.     SANITATION PROCEDURES

4.1 Well Sanitizing: Well sanitizing requires chemical treatment andextended flushing of the well system. Contractor is not responsible for wellpump burnout, electrical failures, pressure switch failures, wiring failures,or pump damage resulting from operation of unstable, aged, deteriorated, orimproperly maintained well systems.

4.2 House Line Sanitation: Sanitizing house lines may release scale,sediment, mineral deposits, sulfur buildup, bacteria buildup, and debristrapped within plumbing systems. Customers are responsible for removing andcleaning faucet aerators, showerheads, and screens as necessary during theflushing process. If Contractor returns to investigate low pressure or odorcomplaints and determines the issue is caused by debris trapped in customerfixtures or screens, additional service charges may apply.

5.     EQUIPMENT-SPECIFIC REQUIREMENTS

5.1 Regeneration Cycles: Sulfur filters, softeners, and whole-house reverseosmosis systems perform automatic regeneration or cleaning cycles. Customersshould avoid water use during regeneration cycles to prevent untreated waterfrom entering household plumbing.

5.2 Under-Sink Reverse Osmosis Systems: Customer is responsible formonitoring all plumbing connections during the first 72 hours followinginstallation or filter replacement. If leaving the home for an extended period,customer should shut off the water supply valve and storage tank valve.Contractor is not responsible for water damage resulting from leaks occurringafter installation.

5.3 Sulfur Filters: Temporary cloudy or milky water may occur followinginstallation due to oxygen trapped within filtration media. This condition isnormal and typically resolves within several days.

5.4 High Water Usage: Excessive water usage may exceed the treatmentcapacity of certain systems and result in reduced performance, sulfur odors,staining, or water quality issues. Activities such as pool filling, irrigation,leaking plumbing fixtures, or abnormal water consumption may affect systemperformance and may void certain warranty coverage.

6.     LIFETIME WARRANTY & SERVICE PLAN REQUIREMENTS

6.1 Warranty Eligibility: Lifetime warranty coverage is available only whilethe customer maintains an active service agreement in good standing.

Warranty coverage is suspended if service is cancelled, discontinued, orfalls delinquent. Contractor reserves the right to require payment of missedservice fees, inspection fees, replacement of neglected maintenance items,system upgrades, or any combination thereof before reinstating warrantycoverage. Warranty coverage is permanently void if equipment is serviced,altered, programmed, adjusted, repaired, or modified by any unauthorized personor third party. Warranty service is limited to normal business hours.Emergency, after-hours, holiday, and weekend service calls are subject toadditional charges.

6.2 Consumable Components: The following items are considered consumable andare not covered under lifetime warranty:

  • Filter cartridges
  • RO membranes
  • UV bulbs
  • Quartz sleeves
  • O-rings
  • Media
  • Carbon
  • Calcite
  • Chemical additives

7.     DISPUTES, INSPECTIONS & LEGAL PROVISIONS

7.1 Right to Inspect and Repair: Before authorizing third-party repairs,filing legal action, or asserting a warranty claim, Customer agrees to provideContractor written notice of the issue and a reasonable opportunity to inspectand address the reported condition. Failure to provide Contractor a reasonableopportunity to inspect and address the reported condition may void applicablewarranties related to that condition and may limit Contractor's liability.

7.2 Mediation & Venue: Any dispute arising from services provided shallfirst be submitted to good-faith negotiation and mediation before legal actionis initiated. Any mediation or litigation shall occur in the county whereservices were rendered and shall be governed by Florida law. The prevailingparty shall be entitled to recover reasonable attorney fees, court costs, andlegal expenses.

8.     DIGGING, TRENCHING & UNDERGROUND UTILITIES WAIVER

When installation requires trenching, excavation, or digging, Contractorwill contact the applicable utility locating service to identify public utilitylines. Customer is solely responsible for identifying and marking all privateunderground facilities including:

  • Irrigation systems
  • Sprinkler lines
  • Landscape lighting
  • Pool plumbing
  • Pool electrical wiring
  • Invisible dog fences
  • Septic systems
  • Sewer laterals
  • Drain fields
  • Private utility lines

Contractor shall not be responsible for damage to unmarked privateunderground facilities. Contractor shall not be liable for normal soilsettling, rutting, landscape disturbance, or restoration associated withnecessary excavation work.

9.     CUSTOMER ACCEPTANCE

By signing an estimate, signing an invoice, making payment, paying adeposit, approving work by email, approving work by text message, verballyauthorizing work, or allowing work to begin, Customer acknowledges that theyhave read, understand, and agree to all terms, warranties, limitations ofliability, maintenance requirements, dispute procedures, and paymentobligations contained in this Agreement.

Customer further acknowledges that these Terms and Conditions apply to allwork performed by Crystal Clear Water Purification, Inc. unless otherwisestated in a separate written agreement signed by both parties.
